1. Acceptance of Terms
By creating an account or using TablePay, you agree to these terms. If you do not agree, do not use the platform. We may update these terms — continued use after changes constitutes acceptance.
2. Description of Service
TablePay provides a QR-based ordering and payment platform for hospitality businesses. Features include digital menus, order management, kitchen displays, staff tools, analytics, payment processing integration, and landing page builder. Features vary by plan.
3. Account Registration
You must provide accurate information when creating an account. You are responsible for maintaining the security of your login credentials. Each business gets a unique username which serves as the login identifier and public URL.
4. Acceptable Use
You agree not to use TablePay for illegal activities, to infringe on others' rights, to transmit malware, to attempt unauthorized access to our systems, or to interfere with other users' experience. You are responsible for all content you upload including menu items, images, and business information.
5. Plans and Billing
Free plans remain free with stated limitations. Paid plans are billed monthly or annually as selected. You may upgrade or downgrade at any time. Annual plans are non-refundable after the first 14 days. Feature access depends on your active plan — downgrading may disable certain features.
6. Landing Page Builder
The landing page builder feature is available exclusively on the Scale plan. Pages are hosted at tablepay.pro/[username]. If you downgrade from Scale, your landing page will be unpublished but data is preserved. TablePay reserves the right to display "Powered by TablePay" branding on free and Growth plan pages.
7. Payment Processing
TablePay facilitates but does not directly process payments. All payment transactions are handled by third-party payment gateways. You are responsible for configuring your payment settings correctly and complying with the payment gateway's terms of service.
8. Data Ownership
You retain ownership of all data you upload or generate through TablePay, including menus, orders, customer data, and analytics. TablePay does not claim ownership of your content. You can export your data at any time.
9. Intellectual Property
TablePay's software, design, branding, and documentation are our intellectual property. Your use of the platform does not grant you any rights to our IP. You may not copy, modify, or reverse-engineer our platform.
10. Availability
We strive for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by third-party services, force majeure, or factors beyond our control.
11. Limitation of Liability
TablePay is provided "as is." We are not liable for lost revenue, data loss, or indirect damages arising from platform use. Our total liability is limited to the fees you paid in the 12 months preceding the claim.
12. Termination
Either party may terminate the agreement at any time. You can close your account from your dashboard. We may suspend or terminate accounts that violate these terms. Upon termination, you have 30 days to export your data before it is deleted.
13. Dispute Resolution
Disputes will be resolved through good-faith negotiation first. If unresolved, disputes will be submitted to binding arbitration. These terms are governed by the laws of the jurisdiction where TablePay is incorporated.
